Mandated Reviews

County planning commission review is required in a number of planning and permitting processes. These requirements may lay in the Pennsylvania Municipalities Planning Code (MPC), the Pennsylvania Code, or be required by federal or state agency regulations. 

Subdivision & Land Development Review

As required by the Pennsylvania MPC, all proposed subdivision and/or land development plans for municipalities with a Subdivision and Land Development Ordinance in York County must be submitted to York County Planning Commission (YCPC) for review. YCPC has 30 days after the proposed plan is received, along with applicable fees, to forward review and comment to the municipal governing body, municipal planning commission, the applicant, and other review agencies and officials as necessary.  

COUNTY SUBDIVISION & LAND DEVELOPMENT APPROVAL

YCPC is the decision-making body for all proposed subdivision and /or land development plans in municipalities that do not have a Subdivision and Land Development Ordinance (currently Delta, Yoe, York Haven, and Yorkana Boroughs). Proposed plans in these municipalities must refer to the York County Subdivision and Land Development Ordinance for plan submission and review procedures. TRAFFIC IMPACT & HIGHWAY OCCUPANCY PERMIT REVIEWS

YCPC reviews traffic impact studies/assessments and PennDOT-required Highway Occupancy Permits. These reviews emphasize capacity, safety, and access issues associated with a proposed site and surrounding area, and complement the reviews conducted by PennDOT staff. New or Amended Ordinance Reviews

Adoption of a new subdivision and land development ordinance or zoning ordinance, or amendment of existing ordinances, requires YCPC review under the Pennsylvania MPC. Review and commentary relate to consistency with the York County Comprehensive Plan, fulfillment of Pennsylvania MPC requirements, and accuracy of the information provided. New or Amended Comprehensive Plan Reviews

Article III of the Pennsylvania MPC requires that proposed municipal or multi-municipal comprehensive plans, or amendments to these plans, be submitted to YCPC for review and comment. Review and commentary relate to consistency with the York County Comprehensive Plan, fulfillment of Pennsylvania MPC requirements, and accuracy of the information provided. Official Map Review

An Official Map Ordinance expresses a municipality’s interest in acquiring certain lands for public purposes, such as streets, parks, and trails, sometime in the future. Article IV of the Pennsylvania MPC requires that proposed Official Map Ordinances, or Map amendments, be submitted to YCPC for review, comment, and recommendation. Review and commentary relate to consistency with the York County Comprehensive Plan and the municipal comprehensive plan, fulfillment of Pennsylvania MPC requirements, and accuracy of the information provided. Act 14 Reviews

The Pennsylvania DEP requires notification of a municipality by an applicant when an environmental permit or permit renewal is sought for a development or facility. YCPC reviews applications involving a broad range of environmental issues, including air and water quality and solid/hazardous wastes, among others. Agricultural Security Area Reviews

YCPC reviews ASAs at 7-year intervals and any time a change in an ASA is proposed. For more information, email the Chief of Municipal Planning.

Sewer Modules & Act 537 Plan Reviews

In accordance with Pennsylvania DEP regulations, YCPC staff completes Sewer Module Component 4B, the form used for revisions to local municipal sewage facilities plans (also known as Act 537 Plans) to accommodate development projects. Act 537 Plans resolve existing sewage disposal problems and provide for future sewage disposal needs. Proposed Plans and amendments must be submitted to YCPC for review and comment. Reviews are based on state requirements, assessment of proposals to address existing/future sewage needs, consistency with the York County Comprehensive Plan and municipal ordinances/plans, and accuracy of the information provided. YCPC is required to review a range of other municipal plans and activities. These include:

  • Recreation, parks, or open space plans adopted as part a municipal comprehensive plan
  • Specific proposed municipal actions related to:
    • Pierheads
    • Public grounds
    • Public structures
    • Sewage treatment plants
    • Sewer lines
    • Streets
    • Water lines
    • Watercourses
  • Proposed actions of public school districts related to the following any school district structure or land:
    • Demolition
    • Lease
    • Location
    • Removal
    • Sale
