Small Wireless Communications Facilities Model Ordinance (PDF)
With the passage of Pennsylvania’s Act 50 of 2021, along with affirmation provided at the federal level for municipal management of the location and management of small wireless communication facilities, it may be appropriate for municipalities to consider updating their existing ordinance language pertaining to small wireless communication facilities or enacting ordinance language that directly addresses and defines the role your municipality wishes to take regarding the installation and location of such facilities. We offer this language that we believe is consistent with the intent of the above-referenced legislation in an effort to ease the challenges that come with dealing with this expanding industry. It clearly presents how you expect communication enterprises to operate within your municipality, while also providing communications companies with a consistent understanding of what is expected of them when proposing new facilities to be located within your municipality.

Solar Energy Systems Model Ordinance (PDF)

Stormwater Management Model Ordinance (PDF)
This Model Ordinance contains standards and criteria consistent with the Act 167 Stormwater Management elements of the Integrated Water Resources Plan (IWRP), of which this Ordinance is a part.

Sustainable Landscaping Model Ordinance (PDF)
The Model Sustainable Landscaping Ordinance is a more holistic approach to the landscaping requirements that are typically found in municipal ordinances. These model regulations are designed to promote sustainable landscapes, conserve and restore healthy soils, reduce the use of irrigation for landscapes, improve the quality of surface waters, reduce energy consumption, provide wildlife habitat, and protect and restore native plant communities. The model ordinance can be used in whole or in part by municipalities and builds off of the existing work that is already in place in many of our municipalities. Development of the Ordinance was a joint effort of the YCPC, Penn State Cooperative Extension, York County Conservation District and consultant, Mary C. Kline, RLA.

Water Supply / Well Testing Model Ordinance (PDF)
The purpose of this Ordinance is to assure that certain water supplies for residential and nonresidential development projects, that are otherwise unregulated by the Pennsylvania Department of Environmental Protection (PA DEP) or the Susquehanna River Basin Commission, are, in as much as practicable, safe, adequate and sustainable, and do not cause potentially adverse impacts to existing water users and the environment.

Wind Energy Systems Model Ordinance (PDF)
It is the purpose of the Model Wind Energy Systems Ordinance to promote the safe, effective and efficient use of wind energy and to reduce the on-site consumption of utility-supplied energy as an accessory use while promoting the health, safety, and welfare of the community through appropriate zoning and land use controls.
